Terms of Service

1. Agreement

By subscribing to Digital Moon Solutions ("the Service"), you agree to these terms. The Service provides managed real estate website hosting, content management, and related services for real estate agents and brokers.

2. Service Description

Digital Moon Solutions provides:

• A professional real estate website hosted on your custom domain
• Content management dashboard for managing listings, profile, and page content
• Image and media hosting
• Contact form with email delivery
• SEO optimization (metadata, structured data, sitemaps)
• SSL certificate management
• Ongoing platform maintenance and updates

3. Subscription and Billing

• The Service is billed monthly at the current listed price ($149/month)
• Payment is processed securely through our payment provider
• Your subscription renews automatically each billing period
• You may cancel at any time; your site remains active until the end of the current billing period
• Refunds are not provided for partial billing periods

4. Your Content

You retain ownership of all content you upload to the platform (listings, photos, text, logos). By uploading content, you grant us a license to host and display it as part of your website.

You are responsible for ensuring you have the rights to all content you upload. Do not upload content that infringes on others' intellectual property rights.

5. Platform Intellectual Property

The website design, layout, code, and platform infrastructure are the intellectual property of Digital Moon Solutions. Your subscription grants you a license to use the platform during your active subscription period.

This license does not transfer ownership of any platform code, design assets, or proprietary systems. Upon cancellation, your license to use the platform ends at the conclusion of your billing period.

6. Acceptable Use

You agree not to use the Service to:

• Publish misleading or fraudulent property listings
• Violate any applicable real estate laws or regulations
• Send spam or unsolicited communications through the contact form system
• Host content unrelated to your real estate business
• Attempt to access other tenants' data or administrative systems

7. Service Availability

We strive for high availability but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by third-party service providers, DNS propagation, or circumstances beyond our control.

8. Cancellation and Data

• You may cancel your subscription at any time
• Upon cancellation, your website will be taken offline at the end of the current billing period
• Your data (listings, photos, content) will be retained for 30 days after cancellation
• You may request a data export before or during the 30-day retention period
• After 30 days, all data is permanently deleted

9. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

Digital Moon Solutions is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless Digital Moon Solutions, its owners, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these terms.

12. Force Majeure

Digital Moon Solutions is not liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, power outages, internet disruptions, government actions, or third-party service failures.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the state or federal courts located in California.

14. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
